Terms of Service
Last updated 11 October 2026
These terms are an agreement between you and Ayush Patil, an individual based in India, who provides Sendwing ("Sendwing", "we", "us"). They cover your use of the website at https://sendwing.app and the Sendwing app and API (together, the "service"). By creating an account or using the service, you agree to them. If you use the service for a business, you agree on its behalf and confirm you're allowed to.
1. The service
Sendwing lets you manage contacts, and send marketing email (campaigns and automations) to them from domains you own. We may change, add or remove features over time. If we remove something significant you pay for, we'll tell you in advance.
2. Your account
- You must be at least 18 and give accurate information when you sign up.
- Keep your password and API keys secret. You're responsible for what happens under your account and workspaces, including what your team members and API keys do.
- Tell us at support@sendwing.app if you think your account has been compromised.
3. Your content and your contacts
You own the contacts, emails, templates and other content you put in the service ("your content"). You give us permission to store, process and send it only as needed to run the service for you.
You're responsible for your content and for having the right to email every contact you add. That means having their consent where the law requires it, and following the email and privacy laws that apply to you and your contacts. For your contacts' personal data, you decide why and how it's used, and we process it on your instructions, as described in our Privacy Policy.
4. Acceptable use
You must follow our Acceptable Use Policy. In short: only email people who asked to hear from you, never send spam or harmful content, and respect unsubscribes. To protect deliverability for everyone, the service may automatically pause sending when bounce or complaint rates get too high.
5. Plans, payment and taxes
- There's a free plan with limits. Paid plans are billed in advance, monthly or yearly, and renew automatically until cancelled.
- Paid plans include a number of contacts. If you go over it, the extra contacts are charged as overage, as shown in the app when you subscribe.
- Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
- Prices may change. We'll tell you at least 30 days before a change affects your subscription.
- You can cancel any time in the app; your plan stays active until the end of the period you paid for.
- Refunds are covered by our Refund Policy.
6. Suspension and termination
We may suspend or end your access, with notice where we reasonably can, if you break these terms or the Acceptable Use Policy, don't pay, or put the service, its sending reputation or other users at risk. You can stop using the service and delete your workspaces at any time. When a workspace is deleted, we delete its data as described in the Privacy Policy.
7. Availability
We work to keep the service running and your data safe, but the service is provided "as is" and "as available". We don't promise it will be uninterrupted or error-free, or that any particular email will be delivered, since delivery also depends on mailbox providers we don't control.
8. Limitation of liability
To the extent the law allows, we aren't liable for indirect or consequential losses, such as lost profits, revenue or data, and our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that can't be limited by law.
9. Indemnity
You agree to cover our reasonable costs from claims by others arising from your content, the email you send, or your breach of these terms or the law.
10. Changes to these terms
We may update these terms. If a change is significant, we'll tell you by email or in the app before it takes effect. Continuing to use the service after that means you accept the new terms.
11. Governing law
These terms are governed by the laws of India. The courts of Pune, India have exclusive jurisdiction over any dispute arising from them.
